These Terms are a contract between you and Viva Peak LLC, located at 30 N Gould St Ste N Sheridan, WY 82801. You agree to these Terms when you create an account, use Get Scam Check, or complete a purchase. If you do not agree, do not use the service.
Who can use the service
You must be at least 18 years old to create an account or make a purchase. You must also be legally allowed to agree to these Terms. The service is not made for children under 13.
If you use the service for a business or group, you promise that you are allowed to agree to these Terms for it.
What the service does
Get Scam Check looks at one public store page and its web address. It checks things such as whether the link works, visible store details, words that rush shoppers, the website's age, and trusted warning lists when available. The checker uses the same rules each time to make a report about warning signs. We may also sell detailed reports or a review written by a person.
The number from 0 to 100 is the total of the points shown in the report. It is not the chance that a store is a scam. It is not proof, approval, or a legal decision about the store.
Reports are not guarantees
A report does not prove that a website is safe, honest, a scam, secure, or free from harmful content. Fewer warning signs do not prove that a site is safe. More warning signs do not prove fraud. Checks can be unavailable, incomplete, out of date, or wrong. A website can also change at any time.
You are responsible for deciding whether to visit a website, share information, or make a purchase. Check unfamiliar sellers yourself. Use a payment method that can help you get your money back. If you think a crime happened or you lost money, contact your bank, payment company, and the police or other proper government office.
Questions and corrections
A seller, website owner, or another person affected by a report may ask us to check something they believe is wrong or has changed. Email support@getscamcheck.com. Include:
- the report link;
- the exact part you think is wrong; and
- proof that supports your request.
While we look into it, we may add a note, fix the report, limit sharing, or remove the report. We do not promise a certain answer. People may still share honest opinions about our service.
How you may use the service
You may use the service to check public website links in a way the law allows. You must not use it to:
- attack a computer system or add harmful software;
- get around locks or try to enter a private computer network;
- use a tool to send too many requests;
- get around service limits;
- commit fraud, such as scamming someone, or send unwanted messages called spam;
- use someone else's work, name, or logo in a way that breaks copyright, trademark, privacy, or another law;
- submit anything against the law; or
- interfere with the service.
Reports are about websites, not people. They are only for shopping-related information. You must not use a report to make or help make a decision about whether a person can get a loan or credit, a job, housing, insurance, government help, or anything else covered by the Fair Credit Reporting Act or a similar law. This is a U.S. law about reports used for decisions like these.
Links you submit and other sites
When you submit a website address, you promise that the law allows you to submit it. You also promise that it has no private sign-in details or private personal information. We remove everything after a question mark (?) or number sign (#) before the check. Even so, submit only a public store page that anyone can open.
We do not control other websites. They remain responsible for what they show, whether they work, what they sell, and what they do.
Accounts and security
You are responsible for activity under your account. You must protect your sign-in and share links. Guest, free, and paid limits apply as shown.
Tell us quickly if you think someone else used your account or share link. We may fix check or detailed-report records changed by a scam or service error.
One-time purchases
The Detailed Report Pack is a one-time purchase. It costs $14.99 and lets you open five detailed reports. Paddle is the company that sells it to you and takes the payment (the “merchant of record”). Before you pay, Paddle shows the final total and any government tax. Paddle also sends your receipt.
When you finish paying, the Paddle Buyer Terms also apply. We do not add another required fee on top of the shown price and government tax.
After Paddle confirms payment, you can use the pack for five detailed reports. Opening the details for one report uses one of the five. Unused reports do not expire right now. You cannot exchange them for cash, move them to another account, or sell them.
You can reopen a paid report only while you can sign in to the account that bought it and the report remains available. This follows our Privacy Policy, the law, and these Terms. If we permanently stop the paid service before you use the detailed reports you bought, we will give the help the law requires, such as a refund when required.
Reviews by a person
You cannot buy a review by a person right now. If we offer it later, the purchase page will show what one review covers, the one-time price, when it should arrive, how to get help, and how refunds work before you pay.
Any finished review will be our best judgment from the information we could check. It will not officially approve the store or prove it is a scam. It will not be insurance or legal advice, and it will not promise that you will get money back.
Subscriptions
We do not offer plans that renew right now. We will not turn one on unless payment clearly shows the price, how often you will pay, the renewal rules, how to cancel, and other important terms. Payment must also ask for any permission the law requires. One-time purchases do not renew.
Refunds and payment problems
Payments handled by Paddle follow Paddle's refund policy. Any extra rights the law gives you also apply. Our Refund policy explains who may get a refund, how to ask, service or delivery problems, timing, and what happens to paid access after a refund.
Tell us and Paddle quickly about a charge made twice, something you paid for but did not get, or a serious problem with a purchase.
Private reports and sharing
Reports are private by default. The owner of a paid detailed report may create a share link made just for that report and cancel the link later. Anyone with a working link can read the shared report, so share it carefully.
The shared page does not include hidden details from the check, account information, or notes from our team.
Service availability and changes
We may update rules and features or correct errors. We may also pause, limit, or stop parts of the service. We do not promise that the service will always work without interruption or error. We also do not promise that we can open every website.
When the law requires it, we will tell you and give the required help for a major change that affects something you paid for but did not get.
Ending or pausing access
We may pause or end your access if you seriously or repeatedly break these Terms, do not pay, create a scam or security risk, or badly misuse the service. When we reasonably and legally can, we will tell you and give you a chance to fix the problem.
You may stop using the service at any time. You may ask us to delete your account as explained in the Privacy Policy. Parts of these Terms that need to continue after access ends will still apply.
Who owns what
Viva Peak LLC owns or has permission to use the service, software, design, brand, and original material. The law protects them. These Terms give you a limited right to use the service for yourself as allowed here. We may take that right away, and you may not give it to someone else.
Links you submit and content from other websites still belong to their owners.
Warranty limits
As far as the law allows, we provide the service "as is" and only when it is available. We do not promise that it will be fit for every purpose, never break another person's rights, always be correct, or always work without stopping. This includes the legal promises called merchantability, fitness for a particular purpose, and non-infringement.
These Terms do not remove any promise or customer right that the law says we cannot remove.
Limits on what we may have to pay (liability)
As far as the law allows, Viva Peak LLC is not responsible for losses that are indirect, unexpected, or meant as punishment, or for losses caused by relying on a report. Lawyers call these incidental, special, consequential, exemplary, or punitive damages. This includes lost profit, income, data, reputation, or a business chance.
As far as the law allows, the most we will be responsible for all legal claims together is whichever amount is larger:
- $100; or
- what you paid us in the last 12 months for the part of the service that caused the claim.
These limits do not apply when the law says we cannot use them. The law where you live may give you more rights.
Law and disputes
Before you start a legal case, please email support@getscamcheck.com. Include your contact details, the purchase or report involved, and what went wrong. We will honestly try to solve the problem without court within 30 days.
This does not change any deadline for starting a legal case. You or we may still ask a court to act quickly.
The laws of Wyoming Law govern these Terms. Rules about choosing another place's law do not apply. Customer protections where you live still apply when the law says they cannot be removed.
If we do not solve the problem, you or we may ask a court that is allowed to hear it, including small-claims court when allowed. These Terms do not force arbitration, a private process used instead of court. They do not remove a right to join a class action, which is one legal case brought by a group, where that right exists.
Changes to these Terms
We may change these Terms for the future. We will post the new text and start date. When needed, we will give more notice of major changes. A change will not go back and change a one-time purchase you already finished.
If you keep using the service after the new Terms start, you accept the changes. If you do not agree, stop using the service.
Other terms and contact
If one term cannot be used exactly as written, we will change only that part as much as needed. The other terms will still apply. If we do not enforce a term once, we may still enforce it later.
These Terms, the Privacy Policy, and the Refund Policy are the agreement between you and us about the service. Paddle's buyer terms also apply when Paddle takes your payment.
